Acceptable Use Policy

This Acceptable Use Policy (“AUP”) describes prohibited uses of the BizTracker website and platform (together, the “Services”). It is incorporated into our Terms of Service and any applicable Subscription Agreement. We may update this AUP from time to time. Capitalized terms not defined here have the meaning given in those agreements.
1. Prohibited activities
You may not use the Services to:
- Violate any law, regulation, or third-party right, or facilitate any illegal activity.
- Send unlawful, fraudulent, deceptive, harassing, or abusive content.
- Distribute malware, ransomware, or other harmful code.
- Attempt to gain unauthorized access to systems, accounts, or data; probe or scan for vulnerabilities without authorization; or circumvent security or access controls.
- Interfere with or disrupt the integrity or performance of the Services (e.g., denial-of-service, excessive automated requests, scraping at scale).
- Reverse-engineer, decompile, or copy the Services except as permitted by law.
- Infringe intellectual property or misappropriate confidential information.
- Upload personal data you are not authorized to process, or special-category data without a lawful basis.
2. Messaging & communications compliance
Because the platform supports SMS and email outreach, you are responsible for complying with applicable communications laws, including the TCPA, CAN-SPAM, carrier requirements (e.g., 10DLC / toll-free verification), and analogous rules in your jurisdiction. Specifically, you must:
- Obtain and maintain appropriate consent before contacting recipients, and keep records of consent.
- Honor opt-out requests promptly (e.g., STOP for SMS; unsubscribe for email). The platform supports TCPA STOP/START opt-out handling, but compliant use is your responsibility.
- Include required sender identification and, for email, a functioning unsubscribe mechanism and valid physical address.
- Not send messages to purchased, harvested, or non-consented lists, and not send prohibited content (e.g., where restricted by carriers).
3. Data & high-risk verticals
You are responsible for the lawfulness of the data you load and the activities you conduct, including any high-risk or regulated verticals you serve. You must maintain all licenses, registrations, and consents your business requires. Do not use the Services to store payment card data outside the scope permitted by your agreement, or to process data in violation of applicable financial, lending, or privacy regulations.
4. AI features
The platform includes AI-assisted features that may take actions subject to confirmation and audit logging. You are responsible for reviewing AI-suggested actions and for the messages and records ultimately sent or stored under your account. Do not use AI features to generate unlawful, deceptive, or abusive content.
5. Enforcement
We may investigate suspected violations and may suspend or terminate access, remove content, or take other action we deem appropriate, with or without notice, to protect the Services, our users, or third parties, or to comply with law. We may report unlawful activity to authorities.
